These Terms of Service ("Terms") constitute a legally binding agreement between you and Timothy Williams ("we," "our," or "us"), the operator of the Tether mobile application and related services (collectively, the "Service"). By downloading, installing, creating an account, or using the Service in any way, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, do not access or use the Service.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the app or by email at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the new Terms.
You must be at least 13 years old to use Tether. By using the Service, you represent that:
You agree to: provide accurate information during registration; maintain the security of your account credentials; notify us immediately at privacy@tetherco.app if you suspect unauthorized access; and accept responsibility for all activity under your account.
You may not create an account on behalf of another person, use a false identity, or create multiple accounts for abusive purposes.
Tether is a private mobile application that enables two users ("a bond") to receive shared prompts and respond to them privately. Core features include text, voice, photo, drawing, and song-based responses; shareable reveal cards; bond milestones; a home screen widget; and an invite system.
We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.
We strive to keep Tether available at all times but do not guarantee uninterrupted availability. The Service may be unavailable due to maintenance, technical issues, or circumstances beyond our control.
Features labeled "beta," "preview," or "experimental" are provided as-is, may be unstable, and may be changed or removed at any time without notice.
Access to Tether may be invite-only at our discretion. Invite credits have no monetary value, are non-transferable, and may be revoked at any time.
Either user may dissolve a bond at any time. Upon dissolution, neither user will see the other's future responses, but each retains access to their own past responses. Tether is not responsible for any harm arising from the formation or dissolution of a bond.
You retain all ownership rights to the content you create and submit through Tether ("User Content"). Nothing in these Terms transfers ownership of your User Content to us.
By submitting User Content, you grant us a limited, non-exclusive, royalty-free, worldwide license to store, reproduce, and display your User Content solely to provide the Service. This license terminates when you delete the content or your account. We do not use your User Content for advertising or training AI models.
By submitting a prompt response, you grant your bonded partner a personal, non-commercial license to view that response within the Tether app. This does not authorize your partner to copy or redistribute your responses outside of app-provided functionality.
You represent and warrant that your User Content does not infringe any intellectual property, privacy, or other rights of any third party, and complies with these Terms and all applicable laws.
You agree not to use the Service to:
We reserve the right to review, monitor, or remove User Content at our sole discretion. We may suspend or permanently terminate your account for any violation of these Terms, particularly for violations involving illegal content, harassment, or threats.
The Service and its original content, features, functionality, design, and branding are the exclusive property of Timothy Williams. The Tether name, logo, and related marks are our trademarks. You may not use our trademarks without prior written consent.
If you believe material on the Service infringes your copyright, send a notice to privacy@tetherco.app including: identification of the work; identification of the infringing material; your contact information; a good faith statement; and a statement under penalty of perjury that you are authorized to act.
The Service may integrate with or link to third-party services governed by their own terms and privacy policies. We are not responsible for third-party content or practices.
Your use of the Service is also governed by our Privacy Policy.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, TIMOTHY WILLIAMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.
You agree to defend, indemnify, and hold harmless Timothy Williams and his affiliates from any claims, damages, losses, and expenses (including attorneys' fees) arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any applicable law.
Before initiating any formal proceeding, contact us at privacy@tetherco.app and give us 30 days to resolve the dispute informally.
If we cannot resolve a dispute informally, any dispute arising out of or relating to these Terms shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, held remotely or in Wake County, North Carolina.
The arbitrator's award shall be final and binding. Either party may seek emergency injunctive relief in court. Intellectual property claims may be brought in court.
YOU AND WE AGREE THAT CLAIMS MUST BE BROUGHT INDIVIDUALLY. THE ARBITRATOR MAY NOT PRESIDE OVER CLASS OR REPRESENTATIVE PROCEEDINGS. If this waiver is unenforceable, the arbitration agreement shall be null and void for that proceeding.
These Terms are governed by the laws of the State of North Carolina. For disputes not subject to arbitration, you consent to jurisdiction of state and federal courts in Wake County, North Carolina.
You may terminate your account via Settings → Delete Account or by emailing privacy@tetherco.app. We may suspend or terminate your account at any time, with or without cause. Sections 7.1, 10, 13, 14, 15, 16, and 17 survive termination.
These Terms and our Privacy Policy constitute the entire agreement regarding the Service.
If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and remaining provisions continue in full force.
Our failure to enforce any right does not constitute a waiver of that right.
You may not assign your rights under these Terms without our written consent. We may freely assign our rights.
We will not be liable for delay or failure to perform due to causes outside our reasonable control, including acts of God, natural disasters, pandemic, war, or third-party service failures.
These Terms do not create third-party beneficiary rights, except as stated in Section 20.
